The Platform operates as an intermediary service provider, connecting users with telecommunications services through third-party carriers and service providers in various jurisdictions worldwide.
Legal Status and Authorization
By using our services, you acknowledge and agree that: (a) the Platform provides access to Virtual Numbers on a temporary rental basis for verification and authentication purposes; (b) Virtual Numbers are not assigned permanently to you and remain the property of the underlying telecommunications service providers; (c) the use of Virtual Numbers is subject to compliance with all applicable telecommunications regulations, data protection laws, and jurisdictional requirements in both the country of service provision and your country of use; (d) you are solely responsible for ensuring that your use of Virtual Numbers complies with all local, state, national, and international laws, including but not limited to anti-spam regulations, privacy laws, and telecommunications regulations.
Service Scope and Limitations
Services are provided on an 'as-is' and 'as-available' basis. Service availability, coverage, and functionality may vary by geographic location, telecommunications carrier policies, third-party platform restrictions, and regulatory requirements. Virtual Numbers are provided for legitimate verification and authentication purposes only. The Platform reserves the right to restrict, suspend, or terminate access to services if such access is used or intended to be used for any illegal, fraudulent, or unauthorized purpose. You acknowledge that Virtual Numbers cannot be used for personal telecommunications services, voice calls, or long-term communications, and are intended solely for the receipt of SMS verification messages during the active rental period.
Compliance and Regulatory Framework
You represent and warrant that your use of the Platform and Virtual Numbers will comply with all applicable laws, including but not limited to: the General Data Protection Regulation (GDPR) in the European Union, the Telephone Consumer Protection Act (TCPA) in the United States, the Canadian Anti-Spam Legislation (CASL), and equivalent regulations in other jurisdictions. You agree not to use Virtual Numbers for any purpose that violates third-party terms of service, facilitates fraud, enables harassment, or infringes upon the rights of any third party. The Platform may refuse service, terminate accounts, or report suspicious activity to relevant authorities in accordance with legal obligations.
EU Consumer Rights Waiver
Digital Service Acknowledgment
By adding funds or purchasing a number, you acknowledge that the service is digital and provided immediately.
Waiver of Withdrawal Right
If you are a consumer in the European Union, you expressly waive your 14-day right of withdrawal under the Consumer Rights Directive, as the performance of the contract has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal.
User Responsibilities
Account Security
You are solely responsible for maintaining the security of your account credentials. Any activity under your account is your responsibility, regardless of who initiated it.
Prohibited Uses
Prohibited activities include but are not limited to: illegal activities, spam, fraud, harassment, abuse of our services, or violation of any applicable laws or regulations.
Financial Services Restriction
1001sms.com does not and will not permit the use of our Virtual Numbers for the verification of any website, app, or service that is related to the financial sector. This includes, but is not limited to, banking services, payment processors, cryptocurrency platforms, cryptocurrency exchanges, financial trading platforms, lending services, insurance services, and any other financial entities. Use of our services for financial services verification is strictly prohibited and will result in immediate account termination.
Compliance and Legal
You must comply with all applicable local, state, national, and international laws and regulations. You are responsible for ensuring your use of our services is legal in your jurisdiction.
Payment Terms
Crypto Payments
Cryptocurrency payments are direct blockchain transactions. They are non-refundable. You are solely responsible for any applicable local taxes and network fees associated with crypto transactions.
Stripe Payments
We use Stripe to process payments. When you make a payment through our service, we share the necessary personal data (such as name, email, billing address, transaction details) with Stripe. Stripe may use this data to provide payment processing and fraud prevention under its own Privacy Policy.
Refund Policy
Cryptocurrency payments are always final and non-refundable due to the irreversible nature of blockchain transactions. Service refunds (to account balance) may be available if you don't receive an SMS code or if a number fails to activate.
Limitations of Liability
Service Availability
We do not guarantee 100% uptime, availability, or uninterrupted access to our services. Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Third Party Blocks
We are not liable for blocks, bans, or verification failures caused by third-party platforms (e.g., Google, WhatsApp, Telegram, etc.). Our service is limited to providing the virtual number; successful account creation depends on many factors outside our control (IP reputation, device fingerprinting, etc.).
Damages Limitation
Our total liability is limited to the amount you paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.
Indemnification
You agree to indemnify, defend, and hold harmless 1001sms.com, its officers, employees, agents, and subcontractors from and against all liability, costs, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms of Use; (c) your violation of any applicable laws or regulations; (d) any claims related to unauthorized access, disclosure, or exposure of personally identifiable data; (e) any acts or omissions by you, your employees, contractors, or affiliates. This indemnification obligation will survive the termination of these Terms and your use of the Services.

Termination by Us
We reserve the right to suspend or terminate your account immediately for violation of these terms, illegal activities, fraudulent activities, abuse of our services, or any reason we deem necessary to protect our services. In case we detect fraudulent activities, we shall immediately report such conduct to relevant authorities and law enforcement agencies. Upon termination for abuse or violation, we may withhold any outstanding account balances.
Effect of Termination
Upon termination, your right to use our services ceases immediately. We are not obligated to provide refunds or credits for unused services or account balances.
Geographic Restrictions & Sanction Compliance
Prohibited Use Based on Geographic Location and Sanctions
The services provided by 1001sms.com are subject to regulations and laws governing international trade and financial transactions, including but not limited to sanctions imposed by the United Nations, the European Union, the United States, and other international bodies and jurisdictions. Consequently, 1001sms.com strictly prohibits the use of its services by individuals, organizations, or entities residing in, located in, or operating from countries or regions that are subject to comprehensive sanctions, including but not limited to the Democratic People's Republic of Korea (DPRK), Iran, Syria, Cuba, or any other jurisdiction where the provision of our services would be illegal under applicable sanctions or laws.
Compliance and Verification

Force Majeure

Assignment
